Ohio Governor Ted Strickland recently signed HB 248 into law which sets forth guidelines governing civil litigation advance contracts in Ohio. Effective as of August 27, 2008, the law gives residents in the State of Ohio access to non-recourse cash advances, also known as pre-settlement legal funds, for their pending legal claims. An individual may receive such an advance to pay living or other expenses while pursuing their legal claim; and, can do so without incurring the obligations associated with a typical loan. A non-recourse cash advance is repaid only if, and when, a legal settlement is successful. If an individual loses their case, the cash advance does not need to be repaid to the funding company.
